  2. (FDA) A product whose legal category, drug, food, dietary supplement or cosmetic, turns on its intended use. Whether it may be sold “depends, among other things, on the intended use of the product and how it is labeled and marketed” (FDA).
  3. (federal hemp law, from Dec. 11, 2026) A kind of hemp-derived cannabinoid product, the term the new federal definition uses for any cannabinoid product made from hemp.

Usage No federal statute defines the phrase “CBD product” itself. The words on the front of the pack, such as full spectrum or isolate, are trade terms; see full spectrum.

How does the FDA treat a CBD product?

By what it is sold as. Meeting the federal definition of hemp does not settle it: a hemp CBD product “still must comply with all other applicable laws, including the FD&C Act” (FDA).

If it is sold as The FDA’s position
A drug, to treat or prevent a disease Needs FDA approval. Only one CBD drug has it.
A dietary supplement Not allowed. The FDA has concluded CBD products are excluded from the dietary supplement definition, because CBD is the active ingredient in an approved drug.
A food or drink, sold across state lines Not allowed. The FDA treats adding CBD to food in interstate commerce as a prohibited act under 21 U.S.C. 331(ll).
A cosmetic No premarket approval, but no ingredient may make a cosmetic adulterated or misbranded.

The FDA has sent warning letters to companies selling CBD products that claimed to prevent, diagnose, treat or cure serious diseases such as cancer, and says some of those products also broke the law by being marketed as dietary supplements or by adding CBD to food.

Is any CBD product FDA-approved?

One. Epidiolex “contains a purified form of the drug substance CBD” and is approved for seizures associated with Lennox-Gastaut syndrome, Dravet syndrome or tuberous sclerosis complex in patients 1 year of age and older. It is available only with a prescription. The FDA says there are “no other FDA-approved drug products that contain CBD” (FDA). This glossary makes no health claim for any CBD product; the what does CBD do entry covers what is known.

What does federal hemp law call a CBD product?

From Dec. 11, 2026, federal hemp law has its own term. A hemp-derived cannabinoid product is “any intermediate or final product derived from hemp (other than industrial hemp), that contains cannabinoids in any form; and is intended for human or animal use through any means of application or administration, such as inhalation, ingestion, or topical application” (P.L. 119-37, sec. 781; date set by H.R. 6500, sec. 2019). The section splits the term in two:

Term in the law What it means THC ceiling
Intermediate product Not yet in final form, or a powder, liquid, tablet or oil meant to be mixed into something else 0.3% combined total THC and THC-like cannabinoids
Final product What the consumer buys and uses 0.4 mg combined total THC and THC-like cannabinoids per container

The law defines a container as “the innermost wrapping, packaging, or vessel in direct contact with” the product, “such as a jar, bottle, bag, box, packet, can, carton, or cartridge”. A product holding cannabinoids made outside the plant falls outside hemp altogether. An FDA-approved drug such as Epidiolex is excluded from the term. State law varies, and some states set their own rules for CBD products; check yours.
